Okay after watching The Dark Knight rises, I'm going to say its a draw. Even. Equal.
The Joker was amazing, than Heath Ledger died which immortalized the role even more so. I'm not going to lie, he opened up a can of worms on best batman villain while also causing uproar that it will never be topped.
Bane on the other hand, was awesome. Tom Hardy killed it. I almost think he had a more scary effect in the sense I'd be willing to take my chances with the Joker.
So which was better?
My pick would be the Joker.
It is close, as far as who played the part better, I have to give the edge to the Joker, as far as who I wouldn't with I would say Bane
It will be hard to ever top Ledger's Joker. It truly was some of the best acting I've ever seen. He nailed the character.
Both were amazing, and so different. I think I like TDKR better than TDK, but if I had to choose which villain was better, I think I give a slight nod to the Joker.
If by nailed you mean copied Tom Waits then yes he nailed it.
The Joker was always my favorite villain of all times, and by far, Ledger's Joker was the most sinister. He really did nail the part as others have said.

It's crazy how exactly Ledger sounds like Waits.
It is, now I am not 100% sure if this is where he got his character from but if it is he nailed the Joker and Waits. Ledger was a method actor so he "became" his roles and it showed as the Joker
